January 1, 2023 arrived quietly for most of the supplement industry. But for any brand selling a product that contains sesame oil, sesame seed extract, or tahini-derived carriers — even trace amounts in a capsule coating — that date marked a hard compliance deadline. The FASTER Act had officially added sesame as the 9th major allergen under federal law, and by FDA’s interpretation, dietary supplements were squarely in scope.

What caught them off guard wasn’t the existence of allergens in their formulas — it was where those allergens came from. Not from the botanical actives. From the excipients holding everything together.
The Regulatory Landscape: FALCPA, the FASTER Act, and Where Supplements Actually Stand
The Food Allergen Labeling and Consumer Protection Act of 2004 (FALCPA) established the U.S. framework for major allergen disclosure. It applies to “food” as defined under Section 201(f) of the FD&C Act — which includes dietary supplements. FDA’s position has been consistent across guidance documents: supplements containing a major food allergen must declare it, using either a “Contains” statement or parenthetical notation in the ingredient list.
The FASTER Act — the Food Allergy Safety, Treatment, Education, and Research Act, signed into law in April 2021 — amended FALCPA by adding sesame as the 9th major allergen, effective January 1, 2023. An estimated 1.6 million Americans live with sesame allergies, making it one of the most clinically significant allergens that federal law hadn’t addressed for nearly two decades. That gap is now closed.
Failure to declare a major allergen isn’t treated as a labeling error. Under 21 CFR § 402(f)(1)(C), a dietary supplement is deemed adulterated when it contains an undeclared allergen that renders it injurious to health. That’s a Class I recall threshold — the same category as microbial contamination. FDA has exercised that authority against supplement products, and the enforcement pattern hasn’t softened.
Where Hidden Allergens Actually Enter Botanical Formulations
The botanical active ingredient is almost never the source of an allergen problem. Ashwagandha root extract doesn’t trigger tree nut reactions. Elderberry powder isn’t cross-reactive with peanut proteins. The risk lives in everything around the herb.
Flow agents and anti-caking agents. Magnesium stearate can be derived from soy, palm, or animal sources. The soy-derived version carries residual allergen risk — particularly when processing controls at the manufacturer are inconsistent. Silicon dioxide is typically safe, but some grades are produced in shared facilities with wheat-containing materials. Rice flour, used as a bulking agent in many botanical capsules, is generally non-allergenic unless co-milled with wheat, which can push cross-contact levels to 20 ppm or above. That’s enough to matter clinically for sensitive individuals.
Carrier oils for fat-soluble botanicals. Softgels delivering curcumin, CoQ10, fat-soluble vitamin complexes, or oil-dispersible botanical extracts rely on a carrier oil. Sunflower and MCT (medium-chain triglyceride) oils are common and non-allergenic. Sesame oil also appears in formulations — particularly in Ayurvedic-derived products — and any product using it after January 2023 must declare it.
Capsule shells and enteric coatings. Hydroxypropyl methylcellulose (HPMC) capsules are plant-derived and allergen-free. Fish-derived gelatin capsules require declaration if the finished product doesn’t otherwise disclose fish. Some enteric coating systems use film-forming agents manufactured in shared facilities with wheat- or tree nut-processing equipment. Knowing exactly what your capsule supplier’s allergen statement covers — including cross-contact disclosures — is non-negotiable.
Cross-contact at the ingredient manufacturer level. A botanical raw material that doesn’t contain an allergen by formulation can still carry allergen protein if it’s been processed on shared equipment. A peanut run on the same production line, even after standard cleaning, can leave behind detectable protein. Without documented cleaning validation and a written allergen cross-contact statement from the supplier, you simply don’t know — and neither does your label.
For brands sourcing ingredients through brokers or spot-buying on the commodity market, this risk compounds. A lot certificate and a COA from an unfamiliar supplier answers none of these questions.
How Analytical Testing Labs Screen for the 9 Major Allergens
The two primary methods used in analytical testing laboratories for allergen verification are ELISA and PCR — and knowing when to use each matters as much as running the test at all.
ELISA (enzyme-linked immunosorbent assay) is the standard for quantitative allergen testing. It works by binding allergen-specific proteins with antibodies and generating a colorimetric response proportional to concentration. A well-validated ELISA reliably detects allergen proteins at 1–5 ppm in most botanical matrices — well below the conservative action thresholds used both clinically and in food manufacturing. ELISA is particularly effective on whole or minimally processed botanicals where target proteins remain intact and immunoreactive.
PCR (polymerase chain reaction) is the better choice when an ingredient has been subjected to high-heat extraction, hydrolysis, or enzymatic processing. Those conditions denature proteins, which can suppress the antibody binding that ELISA depends on — producing false negatives in a matrix that may still carry biologically relevant allergen. PCR detects DNA instead of protein, and DNA is more thermostable than most allergen proteins. The trade-off: PCR is qualitative or semi-quantitative, and it will detect genetic material even if the corresponding allergen protein is absent or denatured beyond clinical significance. A good analytical testing lab uses ELISA as the primary screen and PCR as a confirmatory tool when ELISA returns ambiguous results or when the matrix processing history raises concern.
One practical point most brands miss: allergen testing panels were not uniformly updated after the FASTER Act. Some contract analytical testing labs still offer 8-allergen panels based on the pre-2023 FALCPA list. Any product reformulated, relabeled, or newly developed after January 2023 should be verified with a panel that explicitly includes sesame as the 9th analyte. If you’re uncertain what your current lab’s panel covers, ask for the written method scope before submitting samples.
Building a Pre-Launch Allergen Testing Protocol That Will Hold Up Under Scrutiny
Here’s what a practical allergen verification protocol looks like for a Midwest botanical supplement brand working with external analytical testing labs:
Step 1: Require complete allergen disclosures from every raw material supplier. This goes beyond “contains” information — you need written cross-contact allergen statements covering the supplier’s facility equipment and cleaning validation status. A qualified supplier produces this as part of their standard technical package. If they won’t, treat that as a red flag in your supplier qualification record.
Step 2: Tier your ingredients by allergen risk. Materials produced in dedicated allergen-free facilities, with documented cleaning validation, carry lower risk. Materials from shared production lines or inconsistent sourcing channels carry higher risk. Don’t apply the same testing frequency and scrutiny across both tiers — it wastes budget on low-risk inputs while under-resourcing the ones that matter.
Step 3: Test incoming raw material lots at a frequency appropriate to each tier. For new suppliers or high-risk tiers, test every incoming lot. For established, well-qualified suppliers with consistent allergen documentation, risk-based periodic testing — such as every 10th lot or quarterly — can be appropriate, provided it’s documented in your quality system and reviewed during internal audits.
Step 4: Test finished product before batch release. Especially when reformulating, changing suppliers, or when any excipient source shifts. The finished product test is a final verification that upstream controls actually worked — not an assumption that they did.
Step 5: Update your label and testing protocol when any ingredient changes. A contract manufacturer switching your capsule shell supplier for a “like-for-like” replacement can silently change your allergen profile. Your quality agreement with any co-manufacturer should include mandatory change notification for any ingredient substitution, even cosmetically equivalent ones.
Under 21 CFR Part 111 — the current GMP standard for dietary supplements — allergen controls fall under the broader framework for preventing product contamination and mislabeling. But controls without data don’t satisfy an FDA investigator during a 483 observation review. The question isn’t “do you have allergen controls?” It’s “show me the testing records proving those controls worked at the raw material level.”

The FASTER Act sesame transition is now three years behind us. Most labels have been updated. What hasn’t kept pace — in many of the brands we audit — is the underlying raw material testing documentation to support those labels. If an FDA inspection or a recall investigation puts your allergen controls under a microscope, the question won’t be whether your label says “Contains: Sesame.” It’ll be whether you can produce batch records showing you knew, at the incoming raw material level, what was in the product before it shipped.
That documentation starts with a test report. And the only way to have one is to run the test.
